1. General provisions
1.1. This personal data processing policy of LLC "STEKLOGRAD pro" (hereinafter – Policy) on the website steklogradpro.by (hereinafter – Website) sets out the purposes, principles, methods, conditions for processing personal data, and requirements for protecting personal data processed on this website.
1.2. This Policy on personal data has been developed taking into account the requirements of the legislation of the Republic of Belarus regulating the area of personal data protection.
2. Legal regulation of personal data processing relations
2.1. The Policy on personal data processing is based on the following legal acts:
- Constitution of the Republic of Belarus;
- Law of the Republic of Belarus dated 07.05.2021 No. 99-Z "On Personal Data Protection" (hereinafter - the Law on Personal Data Protection);
- Law of the Republic of Belarus dated 10.11.2008 No. 455-Z "On Information, Informatization and Information Protection";
- other regulatory legal acts of the Republic of Belarus.
3. Terms and definitions used in this Policy
administration – LLC "STEKLOGRAD pro" or its authorized employees who perform the functions of the Personal Data Operator on the Website.
personal data blocking – termination of access to personal data without their deletion;
web counters – online services with embedded code on the site, designed to assess website traffic and analyze user behavior.
personal data anonymization – actions as a result of which it becomes impossible without additional information to determine the belonging of personal data to a specific personal data subject;
personal data processing – any action or set of actions performed with personal data, including collection, systematization, storage, modification, use, anonymization, blocking, dissemination, provision, deletion of personal data;
publicly available personal data – personal data disseminated by the personal data subject themselves or with their consent, or disseminated in accordance with legislative requirements;
operator (personal data operator) – a state body, legal entity of the Republic of Belarus, other organization, individual, including an individual entrepreneur (hereinafter, unless otherwise specified, – individual), independently or jointly with other specified persons organizing and/or performing personal data processing;
personal data – any information relating to an identified individual or an individual who can be identified;
provision of personal data – actions aimed at making personal data available to a specific person or circle of persons;
dissemination of personal data – actions aimed at making personal data available to an indefinite circle of persons;
personal data subject – an individual whose personal data is processed;
cross-border transfer of personal data – transfer of personal data to the territory of a foreign state;
personal data deletion – actions as a result of which it becomes impossible to restore personal data in information resources (systems) containing personal data, and/or as a result of which physical media containing personal data are destroyed;
an identifiable individual – an individual who can be directly or indirectly identified, in particular by last name, first name, patronymic, date of birth, identification number or by one or more characteristics specific to their physical, psychological, mental, economic, cultural or social identity.
cookies – a piece of data sent by a web server and stored on a user's computer, which a web client or web browser sends back to the web server in an HTTP request each time they attempt to open a page on the corresponding site.
IP address – a unique numerical identifier of a device on a computer network operating via the IP protocol.
4. Purposes and legal grounds for personal data processing
4.1. The Administration acts as the personal data operator and processes personal data: messages from feedback forms on the website; other personal data subjects if it becomes necessary to process such data.
4.2. The Administration processes personal data taking into account the need to protect the rights and freedoms of personal data subjects as provided by the legislation of the Republic of Belarus. It is based on the following principles:
- personal data processing is carried out in accordance with legislative requirements;
- personal data processing is proportionate to the declared purposes and ensures at all stages a fair balance of interests of all concerned parties;
- personal data processing is carried out with the consent of the personal data subject, except as provided by law;
- personal data processing is limited to achieving specific, pre-declared lawful purposes. Processing incompatible with the originally declared purposes is not allowed;
- the content and volume of processed personal data correspond to the declared purposes. The processed personal data are not excessive in relation to these purposes;
- personal data processing is transparent.
The personal data subject has the right to receive relevant information concerning the processing of their personal data;
the operator takes measures to ensure the accuracy of the personal data it processes, updates them if necessary;
personal data is stored in a form that allows identification of the personal data subject no longer than required by the declared purposes of personal data processing.
4.3. Personal data on the Website is processed by the Administration for the following purposes:
4.3.1. Establishing feedback with the User, including sending notifications, requests related to the use of the Website, providing services, processing requests and applications from the User.
4.3.2. Providing the User with effective customer and technical support in case of problems related to the use of the Website.
4.3.3. Providing the User, with their consent, with special offers, pricing information, newsletters and other information on behalf of the Website, including via SMS mailings.
4.3.4. Conducting advertising activities with the User’s consent.
5. Personal data subjects processed by the Administration and the list of processed personal data
5.1. The Administration processes personal data in relation to the following personal data subjects:
- Users;
- other personal data subjects for the purposes defined in section 4 of this Policy.
5.2. The personal data permitted to be processed under this Privacy Policy is provided by the User by filling out the initial registration form on the Website, as well as by booking by phone, the feedback form on the website, or through a mobile application:
5.2.1. User’s name;
5.2.2. contact phone number and/or email address;
5.2.3. message from the User;
- information from cookies;
- IP address;
- browser information (or other program accessing advertising display);
- access time;
- address of the page where the advertising block is located;
- address of the previous page.
5.3.1. To disable cookies, the user must block them themselves according to their browser settings. Disabling cookies may result in the inability to access parts of the Website that require authorization. The User may also delete previously saved cookies by selecting the appropriate option in their browser history. Additionally, some browsers allow visiting sites in “incognito” mode to limit the amount of stored information and automatically delete certain types of cookies.
5.3.2. The Website collects statistics on the IP addresses of its visitors. This information is used to identify and solve technical problems.
5.3.3. Any other personal information not specified above (messages from the feedback form) is securely stored and not disclosed, except as provided in paragraphs 6.2. and 6.3. of this Privacy Policy.
6. Methods and duration of personal data processing
6.1. The User’s personal data is processed without any time limit, by any lawful means, including in personal data information systems using automation tools or without such tools.
6.2. The User agrees that the Administration has the right to transfer personal data to third parties, in particular postal services, telecom operators, solely for the purpose of fulfilling the User’s order placed on the Website.
6.3. The User’s personal data may be transferred to authorized state bodies of the Republic of Belarus only on the grounds and in the manner established by the legislation of the Republic of Belarus.
6.4. The Administration takes necessary organizational and technical measures to protect the User’s personal information from unlawful or accidental access, destruction, alteration, blocking, copying, distribution, as well as from other unlawful actions by third parties.
7. Rights of personal data subjects
7.1 Personal data subjects have the right to:
- withdraw their consent to the processing of personal data;
- receive information regarding the processing of personal data and amend personal data;
- request termination of personal data processing;
- request deletion of personal data;
- appeal against actions (inaction) and decisions of the operator related to the processing of personal data.
8. Measures to ensure personal data protection
8.1 The Administration takes necessary and sufficient measures to fulfill obligations to ensure the protection of personal data as provided by the legislation of the Republic of Belarus, including the Law dated 07.05.2021 No. 99-Z «On Personal Data Protection».
The measures taken by the Administration include:
- providing personal data subjects with the necessary information before obtaining their consent to personal data processing;
- explaining to personal data subjects their rights related to personal data processing;
- obtaining written consents from personal data subjects for processing their personal data, except as provided by the legislation of the Republic of Belarus;
- issuing documents that define the Administration’s policy on personal data processing;
- familiarizing employees involved in personal data processing with the provisions of personal data legislation;
- establishing procedures for access to personal data, including those processed on the website;
- implementing technical and cryptographic protection of personal data as established by the Operational and Analytical Center under the President of the Republic of Belarus, in accordance with the classification of information resources (systems) containing personal data;
- ensuring unrestricted access, including via the global Internet, to documents defining the Administration’s policy on personal data processing, before such processing begins;
- terminating personal data processing if there are no grounds for its processing;
- promptly notifying the authorized body for the protection of personal data subjects’ rights of breaches of personal data protection systems;
- amending, blocking, deleting inaccurate or unlawfully obtained personal data;
- limiting personal data processing to the achievement of specific, pre-declared lawful purposes;
- storing personal data in a form allowing identification of personal data subjects no longer than required by the declared purposes of personal data processing.
8.2. Measures to ensure the protection of personal data during their processing are taken in accordance with the Administration’s local legal acts governing the security of personal data during their processing.
9. ADDITIONAL TERMS
9.1. The Administration has the right to amend this Privacy Policy without the User’s consent.
9.2. The new Personal Data Processing Policy comes into force from the moment it is posted on the Website.
